Amazon Bans Sale of CBD; Still Shipped Legally by USPS

As we write about often on our blog, the regulatory state of CBD is in flux, and owners of CBD companies should be aware of the challenges that they have to face in the current market. The world’s largest marketplace, Amazon.com, following the FDA’s finding that CBD cannot be ruled safe, has banned the sale of CBD products from their website. On the positive side, several months ago, the USPS decided that it would be legal for businesses to ship CBD and hemp products through its service, a position which has remained unchanged.

According to respectmyregion.com, “Hemp and CBD products are now domestically mailable, but naturally, under specific conditions. First, the sender must verify their license from the Department of Agriculture. Second, the tetrahydrocannabinol (THC) level of their hemp products can’t exceed a 0.3 percent limit. Once the 2018 Farm Bill is in full effect, USPS said they expect to further modify their currying conditions as states begin to firmly purpose plans.” The article further points out that this decision will benefit people across the country, both medically and by helping to eliminate stigma, and will help the country as a whole by generating more revenue for the US Postal Service.

Meanwhile, CBD products are currently banned from Amazon, although according to a Washington Post report, there are still plenty of CBD products available on the website. Clearly they are not trying that hard to enforce their ban. The Observer notes “The results are especially surprising, considering one product even showed a small trace of tetrahydrocannabinol (THC), the psychoactive compound of cannabis. As the report noted, buyers can usually figure out which brands and products sold on Amazon contain CBD by doing a simple Google search. Not to mention, the countless user reviews mentioning the infusion of hemp are also a pretty good indicator.”
